The Grizzly Bear State Management Act (H.R. 281 and S.316) is a bill that would force the removal of Greater Yellowstone grizzly bears from the Endangered Species Act and hand management authority to the states of Wyoming, Idaho, and Montana.
The bill directs the Secretary of the Interior to reissue the Trump administration’s 2017 delisting rule within 180 days, regardless of other laws that normally govern how wildlife protections are evaluated.
Critically, the legislation also blocks judicial review of that decision. That means scientists, tribes, conservation organizations, and the public would be prevented from challenging the rule in court, even if the delisting ignores the best available science or violates environmental law.
Greater Yellowstone grizzly bears remain one of four isolated populations in the lower 48, and are struggling to expand their range outside the official “recovery zone.” Long-term recovery depends on habitat protection, genetic connectivity with other bear populations, and careful management of human-caused mortality. By mandating delisting through Congress and shielding the decision from court review, the bill bypasses the science-based framework that the Endangered Species Act was designed to provide.
If enacted, the bill would open the door for state-managed trophy hunting of grizzly bears and weaken the safeguards that have allowed the species to slowly recover from near extinction. It represents a political effort to remove protections for an iconic species before recovery is complete, and to strip the public of the ability to hold the government accountable for that decision.
